This bill removes the prohibition on possessing a silencer, which is defined as any device for diminishing the report of a portable weapon or other device from which a shot, bullet, or projectile may be discharged by an explosive. Previously, possessing a silencer was illegal under Georgia law, but this bill repeals that prohibition. However, it creates a new offense for unlawful possession of a silencer if the person knows it is a silencer and also knows they are prohibited from possessing firearms under state law, which would be a felony offense. The bill also makes conforming changes to existing laws regarding dangerous weapons and enhanced criminal penalties, including updating definitions and clarifying exemptions for certain individuals and situations, such as law enforcement officers and those possessing inoperable or federally registered firearms. The changes are set to take effect on July 1, 2026.
