This bill amends existing California law that generally prohibits unsolicited text message advertisements by adding new restrictions on when these messages can be sent. Specifically, it prohibits any text message advertisement, even those that are otherwise allowed because the recipient has an existing relationship with the sender or has consented to receive them, from being sent between 9:00 p.m. and 9:00 a.m. in the recipient's local time zone. The bill also clarifies that senders must adjust message timing based on the recipient's local time zone, and allows recipients to file civil lawsuits against senders who knowingly violate these timing rules, potentially recovering damages, attorney fees, and other relief. Public prosecutors and the Attorney General are also authorized to bring civil actions to enforce these provisions, though violations of this timing restriction will not be considered a crime.
