This bill amends the Mitigation Fee Act to ensure that fees imposed by local agencies on development projects are more directly tied to the actual impact of that development. Specifically, it requires that when a development project involves demolishing or changing an existing use, the fee amount must be reduced to account for the demolition or change, so that the fee only covers the project's new or increased impact on public facilities or services. Additionally, for water and sewer connections, if a project proposes a change in capacity, any associated capacity charge will only be calculated based on that specific change in capacity, and if the existing capacity is greater than the proposed capacity, no refund or credit will be given for the excess capacity to offset other fees.
