This bill concerns administrative rules relating to the uniform rules on agency procedure (uniform rules). The bill rescinds specified administrative rules of various executive branch agencies relating to subjects addressed by uniform rules adopted by the administrative rules coordinator pursuant to Code section 17A.24. The date of rescission is July 1, 2026. The bill provides that the rescinded administrative rules remain applicable to any administrative or judicial proceeding initiated before July 1, 2026, for the pendency of the action. Uniform rules adopted by the administrative rules coordinator pursuant to Code section 17A.24 became effective January 13, 2026 (7 IAC chs. 2500-2506). Subjects addressed by the uniform rules are agency procedures for rulemaking, petitions for rulemaking, waiver of rules, declaratory orders, contested cases, and fair information practices. The bill authorizes an agency to adopt emergency rules providing for additions, exceptions, or amendments to uniform rules adopted by the administrative rules coordinator. The rules shall be effective immediately upon filing unless a later date is specified, but no later than June 30, 2026. The bill specifies that an agency may only adopt such emergency rules if the agency determines a rule is necessary to comply with a legal obligation imposed on the agency or is otherwise determined to be necessary by the agency. The agency must S.F. _____ explain its determination in the preamble of the rulemaking document. The bill provides that a regulatory analysis shall not be required for such rules. This provision is repealed July 1, 2026. The repeal shall not be construed to affect the validity of rules adopted under the provision before the date of repeal. The provision takes effect upon enactment. The bill includes a conforming change relating to the adoption of uniform rules by the administrative rules coordinator.
