This bill modifies West Virginia law concerning liability insurance for county boards of education and other school personnel by reducing the mandatory minimum amount of insurance coverage required for each incident from $1,250,000 to $1 million, and it eliminates the requirement for county boards of education to purchase an additional $5 million in "excess coverage," which is additional insurance to cover claims exceeding the primary policy limits. The State Board of Risk and Insurance Management, an entity responsible for providing insurance to state entities, will continue to offer professional or other liability insurance to cover negligence claims arising from the duties of teachers, administrators, superintendents, and board members, and this bill also clarifies that public charter schools can opt into this insurance coverage under similar terms.
