This bill introduces a new category of thoroughbred horses called "West Virginia Certified Thoroughbreds," which are horses registered with the West Virginia Thoroughbred Breeders Association that have resided in the state for a specific period before their third year, with exceptions for sales or veterinary care, and are subject to verification by the association, though these horses are ineligible for certain premium races and funds. The bill also modifies how revenue from interstate simulcasts (broadcasts of races to out-of-state betting facilities) is distributed, allocating a portion to the Racing Commission General Administrative Account and adjusting how remaining funds are deposited into the purse fund for racing associations. Furthermore, it revises the distribution of "net terminal income" (revenue from video lottery machines after administrative costs) at licensed racetracks, specifically reallocating a portion to the West Virginia Thoroughbred Development Fund and the West Virginia Greyhound Breeding Development Fund, and also adjusts the inflation adjustment for net terminal income deposited into the state Excess Lottery Revenue Fund. Finally, the bill increases the maximum amount a thoroughbred racetrack that did not previously participate in the Thoroughbred Development Fund can use for restricted races.
