AN ACT to amend the executive law, in relation to regulatory penalties, fines, and/or revocation for small business

This bill amends existing law to provide small businesses with a grace period, known as a "cure period" or "opportunity for ameliorative action," to correct first-time violations of state agency rules or regulations, provided these violations are made in good faith and do not involve dishonesty. This means that instead of immediately facing penalties, fines, or revocation of licenses, eligible small businesses will be given a reasonable amount of time, at least fifteen business days, to fix the issue. If a violation is corrected, penalties will be avoided. The bill also requires state agencies to provide small businesses with relevant guidance and information to help them comply with regulations. Furthermore, state agencies must report annually to the Division for Small Business on how many cure periods were granted, successfully completed, and what assistance was provided, which the Division will then compile into a public report. This bill aims to support small businesses by offering a chance to rectify mistakes before facing severe consequences.
