This bill creates a new crime called unlawful operation of a group home, which applies to any person or entity that operates a group home without the necessary licenses or permits. A group home is defined as a residence housing two or more unrelated individuals who receive assistance with daily living activities, and where the operator exercises control over the residents or their assets, which can be proven by actions like holding power of attorney, receiving government benefits on behalf of a resident, or being designated as a responsible party. Penalties vary based on the conditions within the unlicensed home: a fine of up to $1,000 or six months in jail if conditions don't cause suffering, a fine of up to $10,000 or ten years in prison if conditions lead to or cause suffering, with at least one year without parole, and a prison sentence of five to forty years, with at least three years without parole, if the conditions contribute to a resident's death.
