This bill amends the workers' compensation law to provide cost-of-living adjustments for employees with a permanent total disability, meaning they are unable to work in any capacity. These adjustments, called cost-of-living adjustment allowances, will be paid annually in addition to existing disability benefits. The amount of this allowance will be calculated by considering regional cost of living differences and will be equal to fifty percent of the annual increase in the Consumer Price Index (CPI), which is a measure of the average change over time in the prices paid by urban consumers for a market basket of consumer goods and services, as published by the U.S. Department of Labor. This change is intended to help ensure that disability benefits keep pace with inflation.
