This bill establishes a process for recalling members of local boards of education in Kentucky for "neglect of duty," which is broadly defined to include actions like committing wrongful acts in office, accepting bribes, failing to exercise due diligence, violating an oath of office, misusing public funds, habitual impairment due to substance use, certain criminal convictions, or other conduct that adversely affects the administration of the office. The process begins with at least five eligible voters filing a notice of intent with the county clerk to circulate a recall petition, which must then be signed by a number of voters equal to twenty-five percent of the total votes cast in the last election for that position. The petition must be filed within specific timeframes, and if deemed sufficient by the county clerk, the recall question will be placed on the ballot for the next regular election. If a member is recalled, a vacancy is declared and filled according to existing law (KRS 160.190), but the recalled member cannot fill that vacancy and is disqualified from holding state office for four years. The bill also amends KRS 160.190 to explicitly state that members appointed or elected to fill vacancies are subject to this recall process and will hold office until their successor is elected or appointed and qualified, or until they are recalled.
