This bill, known as the Protect Our Games Act, aims to ensure that consumers can continue to enjoy digital games they purchase, even if the game operator stops providing necessary online services. For digital games first available for purchase or rereleased on or after January 1, 2027, game operators must notify players 60 days in advance if they plan to cease services essential for the game's "ordinary use," which means the ability to use the core features as advertised. This notification must include the date services will stop, what features will be lost, any security risks, and how players can continue using the game or get a refund. On the date services cease, operators must either provide an offline version of the game, a patch to enable offline use, or a full refund, and they are prohibited from selling versions of the game that require ongoing online services. The Attorney General or a district attorney can bring civil action against operators who violate these provisions, with exceptions for subscription-based games, free games, and games that can be permanently downloaded for offline use at the time of purchase.
