This bill amends the Western Joshua Tree Conservation Act to allow the Department of Fish and Wildlife (the department) to reduce fees paid in lieu of mitigation for projects that conserve western Joshua trees. Specifically, the bill adds a provision allowing for fee reductions for projects that involve more than one parcel of land, in addition to existing provisions that allow for reductions when a project conserves the tree by acquiring compensatory habitat mitigation land. The Western Joshua Tree Conservation Act generally prohibits the taking, possessing, or selling of western Joshua trees, but allows the department to permit such actions if certain conditions are met, including mitigating impacts to the trees. Mitigation can be achieved through direct measures or by paying fees based on a specified schedule, and this bill expands the circumstances under which those fees can be reduced.
