This bill establishes a new category of alcoholic beverages called "Low-Proof Spirit Alcohol Products," defined as drinks other than wine, beer, or nonintoxicating beer, containing between 0.5% and 15.5% alcohol by volume, and packaged in containers of 25 fluid ounces or less. The bill aims to regulate the manufacture, sale, and distribution of these products, allowing them to be produced and sold under similar conditions and by the same entities authorized to handle nonintoxicating beer, with some exceptions like prohibiting sales in growlers. Manufacturers and suppliers will be subject to a tax of $1.25 per gallon on these products, with monthly reporting and payment required to the Tax Commissioner, and penalties for late filings. The bill also grants rulemaking authority to the West Virginia Alcohol Beverage Control Commissioner and the Tax Commissioner to implement these new provisions, which will take effect 90 days after passage.
