Bill Summary

AN ACT To amend and reenact R.S. 14:34.3(A) and (C) and Children's Code Article 897.1(C), relative to assault and battery; to provide relative to the crime of battery of a school teacher; to provide for penalties; to provide for the disposition of certain offenders; and to provide for related matters.

AI Summary

This bill modifies the existing law regarding battery of a school teacher, which is defined as a battery committed without consent when the offender knows the victim is a school teacher performing their job duties, or if the battery was committed because of the victim's status as a school teacher. For student offenders, if the battery does not cause an injury requiring medical attention, the penalty is reduced to a fine of up to $1,000 or imprisonment for 30 days to six months, with at least 72 hours served without suspension. If a student battery does result in an injury requiring medical attention, the penalty remains a fine of up to $5,000 or imprisonment for 30 days to one year, with at least 72 hours served without suspension; however, for student offenders under 17, the matter will be handled exclusively under the Children's Code. If the offender is not a student, regardless of injury, the penalty is a fine of up to $5,000 or imprisonment for one to five years, or both. Additionally, the bill amends the Children's Code to require that after a finding of delinquency for battery of a school teacher, the court must order the child to participate in court-approved counseling programs, such as anger management, with costs borne by the child or their responsible adult.
