AI Summary

This bill amends existing Louisiana law to establish new protections related to the misuse of artificial intelligence (AI) and an individual's identity. It defines "artificial intelligence" as a system that can perform tasks requiring human-like perception, cognition, or action. The bill creates a specific cause of action, meaning a legal basis for a lawsuit, for using AI to generate or create audiovisual content of an individual's identity for commercial purposes without their consent. This protection applies to individuals domiciled in Louisiana and extends to deceased individuals who were domiciled there at the time of their death. The bill also clarifies that claims for identity rights violations by AI cannot be brought until after August 1, 2026, even though other identity rights protections are effective from August 1, 2022. It maintains existing provisions for remedies such as monetary damages, injunctive relief, and attorney fees, and includes a presumption that alleged violations by media outlets are in furtherance of free speech rights, as per existing legal procedures.
