This bill amends existing law to prohibit the knowing production, distribution, receipt, or possession with intent to distribute, as well as the mere possession, of any visual depiction, including images, films, or computer-generated content, that shows a minor—defined as anyone under 18—engaging in sexually explicit conduct, which includes various forms of sexual intercourse, simulated sexual activity, or exhibition of private body parts, provided that the material is also considered obscene and lacks serious literary, artistic, political, or scientific value. The bill also makes it illegal to knowingly make available to or distribute such obscene or sexually explicit material to a minor, and it outlines specific penalties for violations, ranging from fines and imprisonment of up to two years for distributing to a minor, up to five years for possession of such material, and up to fifteen years for producing or distributing it with intent to share. Importantly, the bill includes affirmative defenses for possession of a limited number of such depictions if the individual promptly destroys them or reports them to law enforcement, and it clarifies that the depicted minor does not need to be a real person for the offense to apply.
