This bill strengthens quality assurance and testing regulations for the commercial cannabis market overseen by the Department of Cannabis Control by making all cannabis and cannabis products subject to testing or retesting, and by permitting laboratories to retest samples if a test is compromised by equipment malfunction or staff error, if the department requires it, or if the department approves a request to do so. To protect consumers and ensure regulatory compliance, the legislation requires cannabis retailers and other licensed sellers to provide the certificate of analysis—a document detailing a product's chemical profile and confirming it meets safety standards—to customers upon request, and to grant the department access to products for off-the-shelf laboratory testing. Additionally, the bill mandates that licensed testing laboratories participate in performance testing, such as blind proficiency and round-robin testing, to guarantee consistency and competence across different facilities, and requires them to comply with department evaluations of their testing practices.
