This bill, by adding Section 1798.309 to the Civil Code, establishes new protections for individuals and entities in California involved in "legally protected health care activity," which includes services like reproductive and gender-affirming care that are lawful in California. The bill prohibits any person or entity operating in California from complying with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons seeking information about such protected health care activities unless specific conditions are met. These conditions include the inquiry containing a sworn affidavit stating it's not related to actions unlawful in California or that it pertains to activity specifically identified as unlawful under California law, and that the recipient has notified the California Attorney General and attempted to notify the individuals involved in the health care activity at least 30 days prior to disclosure. The Attorney General is authorized to intervene in legal actions challenging these inquiries and can bring civil actions against those who submit false affidavits, imposing a $15,000 civil penalty. The bill also allows the Attorney General to seek penalties of $10,000 for a first violation and $15,000 for subsequent violations against those who intentionally or recklessly comply with such inquiries in violation of these new provisions, and the court must award court costs and attorney's fees to the Attorney General in any successful enforcement action.
