This bill, titled the Truth in Giving Act, aims to ensure transparency for individuals donating consumer goods for resale by thrift operators, which are businesses that sell donated items. The act requires these thrift operators to clearly disclose whether donations are benefiting non-profit charitable organizations or for-profit businesses. Specifically, if a thrift operator is a registered charitable organization or a 501(c)(3) tax-exempt organization (meaning it's recognized by the IRS as tax-exempt), they must provide their name, address, and phone number to donors and customers. However, if the thrift operator is a for-profit business, they must clearly state "THIS IS NOT A CHARITY. DONATIONS MADE HERE SUPPORT A FOR-PROFIT BUSINESS" and provide the name, address, and phone number of the entity collecting the donations. These disclosures must be prominently displayed on donation drop boxes, at donation drop-off locations, provided before at-home pickups, and at the point of sale for thrift sales. The bill also establishes enforcement mechanisms, including investigations by the Secretary of State, and outlines civil and criminal penalties for violations, ranging from fines and jail time for individuals and injunctions against businesses. The Secretary of State is also empowered to create rules to implement this act.
