This bill establishes provisions for the automatic dissolution of homeowner's associations (HOAs) in Idaho, which are organizations that manage common areas and enforce rules within a neighborhood. Under this new law, any HOA that has existed for ten years or more as of July 1, 2026, will automatically dissolve on July 1, 2029, unless its members vote to prevent it. Similarly, HOAs formed after July 1, 2026, or those less than ten years old on that date, will automatically dissolve ten years after they were incorporated, again, unless members vote against it. To allow for this vote, HOAs must hold a membership meeting before the automatic dissolution date, providing notice that includes the purpose of considering dissolution and a plan for how the HOA's assets, like common property, will be handled, potentially by transferring them to lot owners or local government. If a majority of eligible voters choose not to dissolve, the HOA continues, but it will face automatic dissolution every ten years thereafter unless members vote against it each time. The bill also declares an emergency and sets an effective date of July 1, 2026.
