This bill establishes new provisions in Idaho law regarding the use of human fetal tissue in products, requiring that any product using ingredients or additives subjected to human fetal tissue in its testing or production phase must be explicitly labeled to indicate this inclusion. This labeling requirement applies to vaccinations and medical products, and covers situations where testing was performed on the final product, its components, or specific production batches. Manufacturers are held strictly liable for violations, while retailers are liable only if they knowingly fail to label a product that requires it. The Attorney General can seek injunctions and civil penalties of up to $5,000 per violation or 5% of the gross revenue from the sale of the violating product. Affirmative defenses are available if consumers are clearly informed of the use of human fetal tissue during purchase, or if manufacturers have policies ensuring compliance and inform retailers, and retailers rely in good faith on manufacturer labeling; however, being based outside of Idaho is not a defense. "Human fetal tissue" is defined broadly to include tissue or cells from a deceased human embryo or fetus, as well as any derived cells, cell lines, or biological matter like DNA or proteins. The bill also declares an emergency and sets an effective date of July 1, 2026.
