This bill repeals an existing law and enacts new provisions to define and criminalize three specific election-related offenses in Idaho, all classified as felonies. Firstly, it establishes the crime of illegal voting, which includes any person not entitled to vote who fraudulently casts a ballot, or anyone who votes more than once in a single election or knowingly submits multiple ballots together. Secondly, it defines the crime of interference with an election, encompassing actions such as altering ballots after they've been placed in the ballot box, adding or attempting to add fraudulent ballots during or after counting, or removing, destroying, or mutilating election materials like poll lists, ballots, or ballot boxes with the intent to disrupt or invalidate an election, or otherwise interfering with election officials or voters to prevent a fair election or canvass. Lastly, it creates the crime of tampering with voting machines or vote tally systems, which involves interfering with these devices in violation of specific existing Idaho Code sections. The bill also declares an emergency and sets an effective date of July 1, 2026.
