This bill requires that when a municipality proposes to annex land by ordinance, it must personally serve notice of this proposed annexation to affected towns and by certified mail to all landowners within and bordering the area to be annexed, and this notice requirement is crucial for the annexation ordinance to take effect. Specifically, it amends Minnesota Statutes section 414.033, subdivision 2b, to replace notice by certified mail with personal service for affected towns, while still requiring certified mail for landowners, and adds that the ordinance will not be valid if these notice requirements are not met, with these changes becoming effective on August 1, 2026, and applying to ordinances adopted on or after that date. Additionally, it amends subdivision 3 of the same statute to require personal service of notice of intent to annex upon the town board for smaller annexations (40 acres or less) that are significantly bordered by the municipality (60% or more), and also states that such an ordinance will not take effect if the municipality fails to comply with these notice requirements, with the same effective date and applicability.
