Bill Summary
AN ACT to amend the education law, in relation to prohibiting the ownership, operation or control of pharmacies by pharmacy benefit managers
AI Summary
This bill amends education law to prohibit pharmacy benefit managers (PBMs) from directly or indirectly owning, operating, or controlling pharmacies, and vice versa, meaning a PBM cannot also own or control a pharmacy, and a pharmacy cannot be owned or controlled by a PBM. A PBM is defined as having the same meaning as in section two hundred eighty-a of the public health law, which generally refers to entities that administer prescription drug benefits on behalf of health insurers, Medicare Part D drug plans, or other payers. Any entity violating this provision will have three years from when the law becomes effective to sell off its ownership or control of the pharmacy. This act takes effect immediately.
