Bill Summary

AN ACT To amend Chapter 1 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions of state government, so as to require state agencies to provide a notice to employees when using artificial intelligence in personnel matters; to require a governmental agency to issue a disclaimer regarding the use of artificial intelligence; to provide for definitions; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill requires state government agencies in Georgia to inform employees when artificial intelligence (AI) is used in personnel matters, defining AI as any system that can make predictions, recommendations, or decisions influencing environments without significant human oversight, or that can learn from data, including tools like automated scoring systems and machine learning. Specifically, if an agency uses AI in the hiring process, the job description must include a disclaimer stating that AI might be used to evaluate applications. Furthermore, if AI is used to evaluate an employee's performance in a way that leads to termination, the agency must provide a disclaimer detailing all decision pathways that resulted in the termination, including documentation of human review of those pathways. In addition to these specific requirements, all disclaimers must also explain how the AI was adopted and deployed, along with any data, sources, or metrics used in its operation.
