This bill modifies existing law regarding background checks for individuals working in community care facilities, which are licensed by the State Department of Social Services to provide care for children and other vulnerable populations. Currently, these facilities must check various registries, including out-of-state child abuse and neglect registries, for individuals who have lived elsewhere in the past five years before approving them. This bill allows a community care facility licensee to provisionally approve an individual to care for children before the out-of-state child abuse and neglect registry check is fully completed, provided that the facility has requested the check, the individual has passed all other background checks (like those from the Department of Justice and the FBI), and the individual does not have unsupervised contact with residents until the out-of-state check is finished. If the out-of-state check reveals disqualifying information, the licensee must immediately remove the individual and notify the department within three business days, as failing to do so constitutes a crime.
