This bill requires that any opening, such as a window or perforation, on the identification envelope used for mail-in ballots must be positioned at least one-half inch away from any area on the ballot where a voter needs to mark their choices, known as a "fillable field," when the ballot is properly inserted. The Secretary of State will create rules to ensure these envelopes and ballots align correctly and that manufacturers can prove compliance, with these new rules taking effect for elections held after January 1, 2028. This change is considered a state-mandated local program, meaning local election officials will have new duties, and the state will reimburse them for any associated costs if the Commission on State Mandates determines they are state-mandated.
