This bill modifies existing law regarding amendments to declarations for common interest developments, which are communities like homeowners associations where individual ownership is combined with shared ownership of common areas. Currently, if a declaration requires more than 50% of member votes to approve an amendment, an association or member can petition a court to lower this threshold. The court can grant this if, among other things, more than 50% of members voted in favor. This bill introduces a new provision allowing a court to approve an amendment with a lower threshold of just over 37% of votes, but only if the common interest development is a senior citizen housing development, has over 6,000 separate interests (individual units or lots), more than 25% of those interests are only occupied part-time by owners, more than 25% are occupied by tenants, and the declaration has not been amended in at least 35 years.
