This bill strengthens the privacy and confidentiality protections for demographic data regarding sexual orientation, gender identity, and intersex status, collectively referred to as SOGISC, which is collected by various California state agencies and public postsecondary education institutions under the existing Lesbian, Gay, Bisexual, Transgender, and Intersex Disparities Reduction Act. Building on laws that allow individuals to voluntarily self-identify these traits, the legislation strictly prohibits state entities from disclosing personally identifiable SOGISC data—as well as information that could reasonably be used to infer someone's transgender or intersex status—to any entity outside of California state or local government, except under narrow and specific circumstances like valid court orders, necessary public health interventions, or mandatory federal program requirements. Additionally, the bill explicitly exempts SOGISC data from public inspection under the California Public Records Act, ensuring that records remain confidential unless properly deidentified, and ties violations of these rules to the penalties outlined in the Information Practices Act of 1977, which governs how state agencies handle personal information.
