This bill establishes new requirements for private civil detention facilities, which are facilities operated by private companies under contract with the government to hold individuals awaiting immigration proceedings or transfers, and are distinct from prisons or jails for criminal offenses. The bill mandates that the state's health department create rules for these facilities covering sanitary, hygienic, and safe conditions, as well as inspections and enforcement. These rules must ensure a safe and clean environment, regular cleaning of living areas, provision of basic hygiene items at no cost, nutritious meals, an infection control program, accommodations for individuals with disabilities, adequate lighting and hot/cold water, accessible telephones for confidential and emergency calls, private visiting areas, written policies to protect detained individuals' rights and prevent abuse, sufficient qualified staff, and staff training on emergency plans, infection control, and individual rights. The health department will conduct unannounced inspections, investigate complaints, and post inspection results online and at the facilities. If violations are found, the department can impose corrective actions, require training or consultants, or levy civil fines of up to $10,000 per violation, with a maximum of $1,000,000, especially for repeat offenders or those who fail to correct issues. These provisions will take effect on May 6, 2026.
