This bill authorizes the Bureau of Funeral Directing, under the Commissioner of Health, to investigate claims related to money paid for funeral merchandise or services, and to take action against individuals or entities falsely representing themselves as licensed funeral directors or firms. Specifically, before the Attorney General can start a legal proceeding, the Bureau must investigate claims and, after 90 days, transfer its findings to the Attorney General. The Bureau also gains the authority to investigate and, following proper procedures, impose fines and penalties on unlicensed individuals or unregistered businesses that falsely claim to be licensed or registered funeral directors or firms, which is a violation of public health law.
