This bill enacts new provisions for R.S. 8:659(C) and (D) to clarify who has the authority to decide on the interment, or burial, of certain individuals' remains. Specifically, if a person dies while serving in the U.S. Armed Forces, Reserves, or National Guard in a manner described by federal law (10 U.S.C. 1481(a)(1) through (8)), and they completed a Department of Defense Record of Emergency Data, known as a DD Form 93, the person designated on that form as the "Person Authorized to Direct Disposition" (PADD) will have the right to control the interment. The bill also states that cemeteries, funeral homes, and their staff will not be held liable for following the PADD's instructions based on the DD Form 93, or for relying on the PADD's statement about the circumstances of death. Furthermore, if a person made multiple notarized documents regarding their final wishes, the most recent one will be followed. If a person made notarized documents and also completed a DD Form 93, the document (whether a testament, declaration, or DD Form 93) that is dated last will determine the interment arrangements.
