AN ACT To amend Title 20 of the Official Code of Georgia Annotated, relating to education, so as to authorize public schools and postsecondary educational institutions to consider antisemitism in the same manner as discrimination based on religion; to require the Department of Education to establish a state-wide K-12 Title VI Coordinator; to require the Board of Regents of the University System of Georgia and the State Board of the Technical College System of Georgia to establish a state-wide Higher Education Title VI Coordinator; to authorize withholding of funds for noncompliance; to provide for notice and appeal procedures; to provide for definitions; to provide for an effective date; to provide for annual reporting; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill requires public schools and postsecondary educational institutions in Georgia to consider antisemitism, which is prejudice or discrimination against Jewish people, in the same way they consider discrimination based on religion. It mandates the creation of a statewide K-12 Title VI Coordinator within the Department of Education to handle complaints of discrimination and harassment under Title VI of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, or national origin in programs receiving federal funding. Similarly, the University System of Georgia and the Technical College System of Georgia must establish a statewide Higher Education Title VI Coordinator to address such issues at colleges and universities. These coordinators will be responsible for creating complaint processes, investigating allegations, and recommending corrective actions, with the possibility of withholding state funds from institutions that fail to comply after being given 30 days to fix the problem, though institutions can appeal such decisions in court. The bill also requires annual reports on these activities and ensures that these new provisions do not infringe upon First Amendment rights.
