Specifically, when a plaintiff files this notice after attempting to serve landowners by mail, they must now include an affidavit from the person who mailed the notice, along with the certified or registered mail delivery receipt for each parcel, detailing the date, time, and place of mailing, and this affidavit must be signed by the recipient or their representative. If mail delivery fails and the notice must be posted on the property, the plaintiff must also submit an affidavit detailing the date, time, and location of each posting, accompanied by a photograph of the posted notice. These changes aim to strengthen the proof of service and ensure that all parties with potential groundwater rights are properly notified of the adjudication process, which is a legal proceeding to comprehensively define and manage water extraction rights within a groundwater basin.
