This bill clarifies that for certain employment provisions in the Education Code, both public school employees and contractors providing services in public schools are considered "natural persons," meaning individual human beings. It also establishes protections for certificated and classified employees of local educational agencies (school districts, county offices of education, and charter schools) and academic and classified employees of public postsecondary education systems (University of California, California State University, and California Community Colleges). Specifically, these employees cannot be disciplined, reassigned, or retaliated against for refusing to use, deploy, or direct students to use any form of educational technology, nor can they face negative actions based on information generated by artificial intelligence (AI) or automated decision systems (ADS). Furthermore, any educational technology deployed in the workplace must allow employees to easily disable it without charge, and the bill requests the University of California to adhere to these requirements. An ADS is defined as a computational process that uses AI or similar technologies to make decisions impacting individuals, excluding basic tools like spam filters or calculators.
