This bill, known as the Digital Dignity Act, aims to protect individuals from the misuse of their likeness and voice through digital replicas, which are realistic, computer-generated depictions created by technologies like generative artificial intelligence (AI). It establishes new legal provisions that hold individuals liable if they knowingly distribute content containing a digital replica and are found guilty of false impersonation or liable for defamation in a civil action. Furthermore, it requires large online platforms that offer generative AI tools capable of creating digital replicas to provide a mechanism for individuals to report content that violates their terms of service or the law, and to submit court orders for the removal of such content; upon receiving a court order, these platforms must promptly remove the digital replica and attempt to remove identical copies. The bill also authorizes city attorneys and the Attorney General to bring civil actions to enforce these provisions, seeking penalties and injunctions, and mandates that generative AI tool providers retain records for 90 days to aid in compliance with court orders. Additionally, it amends existing civil law to allow individuals to seek damages, including liquidated damages or actual damages, and injunctive relief when their digital replica is used without consent in a manner that leads to defamation or false impersonation, clarifying that these rights are property rights and providing specific exemptions for news reporting, commentary, parody, and satire.
