This bill proposes to create an "educational asylum program" within California's public postsecondary education system, which includes the California Community Colleges, the California State University, and the University of California. The program aims to allow students from states that have enacted legislation restricting the teaching of diversity, equity, and inclusion, or critical race theory (defined as "restricted states") to transfer to California institutions without paying higher tuition fees for nonresidents. The State Department of Education will maintain a list of these "restricted states" and inform participating institutions, which can be any of the public colleges or universities. If a transfer student meets the institution's academic admission standards, resides in a listed restricted state, and applies for this status, they can be granted "educational asylum status." Starting with the 2027-28 school year, these students will be exempt from nonresident tuition and will only pay the same resident tuition and fees as California students, with institutions encouraged to use existing funds to manage the program.
