This bill, the Affordable Housing and High Road Jobs Act of 2022, aims to streamline the approval process for certain mixed-income housing developments by allowing them to be built "by right," meaning they are not subject to discretionary local government approvals and are considered exempt from certain environmental review requirements under the California Environmental Quality Act (CEQA). It modifies existing law to prohibit objective development standards from preventing a housing project from being built at its required residential density or forcing a reduction in unit size, and importantly, it now also prohibits these standards from limiting mixed-use development within a housing project. The bill also clarifies the definition of "use by right" to explicitly state that any required state or local permit or approval for the development project is not considered a "project" under CEQA, further simplifying the process. Furthermore, it clarifies that these changes apply to all cities, including charter cities, as housing is considered a matter of statewide concern.
