Bill Summary

Under current law, a person with a disability, a person assisting a person with a disability by controlling a service animal or a service-animal-in-training, or a person training a service animal has the right to be accompanied by a service animal or service-animal-in-training to streets, highways, sidewalks, walkways, public buildings, public places, public elevators, public facilities, common carriers, airplanes, motor vehicles, railroad trains, motorbuses, streetcars, boats, public conveyances or modes of transportation, hotels, lodging places, eating places, places of public accommodation or amusement or resort, and other places the general public is invited. A person who knowingly denies or interferes with this right is guilty of a simple misdemeanor. This bill specifies that the right to be accompanied by a service animal or service-animal-in-training also applies in any other place where a service animal or service-animal-in-training is permitted or allowed under state or federal law.

AI Summary

This bill clarifies that individuals with disabilities, or those assisting them with a service animal or a service animal in training, have the right to be accompanied by their animal not only in the places already specified by law, such as public buildings and transportation, but also in any other location where service animals are permitted by state or federal law. This expansion ensures that the rights of individuals with disabilities and their service animals are protected in all legally permissible environments, reinforcing existing protections against denial of access and maintaining the penalty of a simple misdemeanor for violations.
