Bill Summary

This bill relates to intimidation with a dangerous weapon. The bill removes from the bill language referring to the shooting, throwing, launching, or discharging of a dangerous weapon within an assembly of people, and thereby placing the occupants or people in reasonable apprehension of serious injury, but includes the shooting, throwing, launching, or discharging of a weapon at another person. A violation of the bill is either a class “C” or class “D” felony depending on the circumstances. A class “C” felony is punishable by confinement for no more than 10 years and a fine of at least $1,370 but not more than $13,660. A class “D” felony is punishable by confinement for no more than five years and a fine of at least $1,025 but not more than $10,245.

AI Summary

This bill amends existing law regarding intimidation with a dangerous weapon by changing the specific actions that constitute a crime. Previously, the law covered situations where a dangerous weapon was discharged within an assembly of people, causing fear of serious injury, but this bill removes that provision. Instead, it now specifically includes the act of shooting, throwing, launching, or discharging a dangerous weapon *at another person* as a criminal offense. The severity of the crime, and thus the penalty, depends on the circumstances: a class "C" felony, punishable by up to 10 years in prison and significant fines, or a class "D" felony, punishable by up to five years in prison and lesser fines.
