Bill Summary

This bill revises the definition of “public improvement” for purposes of Code chapter 26 (public construction bidding) to exclude equipment acquired by or for a city utility under Code chapter 388 when such equipment is related to an electric generating project and to exclude the furnishing of a manufactured home, including the erection of the foundation or tiedown system, supporting, anchoring, and close-up of the home, and implementing the utility service connections for the home. By operation of law, the bill affects the term “public improvement” as used in Code chapter 26A (guaranteed maximum price contracts) and in Code sections 8.46 (lease-purchase reporting); 260C.38 (community college lease-purchase contracts); 278.1 (school district lease-purchase contracts); 297.7 (construction, renovation, and repair of school buildings); 298.3 (school district levy revenue); 331.341 (county board of supervisors contracts); 364.4 (city lease-purchase contracts); and 384.20 (city finance accounts).

AI Summary

This bill modifies the definition of "public improvement," which is a term used in laws governing public construction bidding, to exclude certain items. Specifically, it excludes equipment purchased by or for a city utility (a local government entity that provides services like electricity) for an electric generating project, and it also excludes the entire process of providing and installing a manufactured home, including its foundation, anchoring, and utility connections. These changes will also affect other related laws concerning guaranteed maximum price contracts, lease-purchase agreements for community colleges and school districts, school building projects, county and city contracts, and city finance accounts.
