This bill modifies existing Minnesota law to regulate the manufacture, sale, and use of fireworks, and to dedicate a portion of the revenue generated from their sale to public safety. Specifically, starting after June 30, 2025, a portion of the sales tax collected on "aerial and audible devices" (defined as fireworks suitable for public use, containing specific amounts of chemical mixture, and listed in the American Pyrotechnics Association Standard 87-1) will be directed to the volunteer fire assistance grant account and the fire safety account, with the remainder going to the general fund. The bill also updates the definitions of various types of fireworks, including "aerial and audible devices," "display fireworks," "fireworks," "novelties," and "sparkling devices," and clarifies that the possession or use of sparkling devices, novelties, or aerial and audible devices is not permitted on public property, and purchasers must be at least 18 years old with photographic identification verified by sellers. Additionally, the bill allows retail sellers of these items to operate from temporary structures for up to 45 days annually and sets limits on local government licensing fees for such sales, while also preventing local governments from imposing additional fees or restricting the sale or display of these items beyond what is specified in the bill, though cities, towns, and counties retain authority to regulate the conditions of sale or use.
