This bill would require the Civil Rights Department to annually publish a report detailing the aggregate budgetary and enforcement information for the Civil Rights Enforcement and Litigation Fund, which is used to offset the department's costs. This fund is replenished by attorney's fees and costs awarded to the department when it prevails in civil actions under the California Fair Employment and Housing Act, as well as civil penalties collected from employers. Additionally, the bill significantly increases the penalty for employers who subsequently fail to submit their required annual pay data report to the department, raising it from a maximum of $200 per employee to a maximum of $1,000 per employee, with these penalties also going to the aforementioned fund. The pay data report requires private employers with 100 or more employees to submit information on their workforce by race, ethnicity, and sex, including median and mean hourly pay within each job category.
