This bill establishes a pilot program in seven California counties (Los Angeles, San Diego, Fresno, Santa Clara, Shasta, Kern, and San Bernardino) to address excessive speeding, reckless driving, and exhibitions of speed by requiring individuals convicted of these offenses to install a certified active intelligent speed assistance device (ISA) on any vehicle they operate. An ISA is an aftermarket device that uses location-based technology to actively limit a vehicle's speed to posted limits and is tamper-resistant. The bill makes ISA installation discretionary for first-time offenders, similar to existing ignition interlock device (IID) requirements for driving under the influence offenses, and sets mandatory installation periods based on the number of prior offenses, ranging from 12 to 48 months. Tampering with the device, operating a vehicle without it, or failing to return it after program completion will be a misdemeanor, extending the required installation term by 120 days for each violation. The program also includes a fee schedule for ISA services, with costs adjusted based on income, and requires ISA providers to maintain data confidentiality and security. The Department of Motor Vehicles (DMV) will oversee the program, and both the DMV and the Transportation Agency are required to report on its implementation and effectiveness to the Legislature by July 2031 and July 2032, respectively. This pilot program is set to conclude on January 1, 2033.
