This bill establishes a producer responsibility program for waste lubricants and their packaging, aiming to ensure their safe and proper management and reduce environmental harm. It defines "covered liquid product" as various petroleum-based or similar fluids used in mechanical systems, and "covered packaging product" as the primary containers for these liquids, excluding metal containers. Producers of these "covered products" will be required to register with a Producer Responsibility Organization (PRO), a non-profit entity responsible for developing and implementing a plan for collecting and managing these wastes. This plan must include a funding mechanism, a system for convenient collection at no cost to residents, and provisions for reimbursing local governments for their collection and management costs. The bill mandates that the PRO develop and submit this plan to CalRecycle (California Department of Resources Recycling and Recovery) for approval, with regulations to be adopted by CalRecycle in coordination with DTSC (Department of Toxic Substances Control), and the program to be effective no earlier than January 1, 2029. Producers will also pay an annual administrative charge to CalRecycle and DTSC to cover program oversight costs. The bill exempts covered packaging products from existing plastic packaging producer responsibility laws and establishes a new fund for collected penalties and administrative charges.
