This bill amends West Virginia law to remove electrical transformers from a list of exemptions for aboveground storage tanks (ASTs), meaning that ASTs containing electrical transformers will now be subject to the regulations outlined in this article, which generally applies to all ASTs and the regulated substances they store. An AST is defined as a device holding over 1,320 gallons of liquid, primarily made of non-earthly materials, with more than 90% of its capacity above ground, including associated pipes and dispensing systems. Previously, electrical equipment like transformers were specifically exempted from these regulations, but this bill adds transformers back into the scope of regulated ASTs, alongside other exempted categories such as shipping containers, barges, swimming pools, process vessels, and certain water or food storage devices.
