This bill establishes a new requirement for hospitals in Minnesota to undergo a public interest review by the Minnesota Department of Health (MDH) before making significant changes to their operations. Specifically, a hospital, defined as an acute care institution licensed under state law, cannot curtail its operations to the point of requiring patient relocation, move health services to another hospital or campus, or stop offering operating room, intensive care unit, or overnight pediatric services without first getting approval from the MDH. This review process is intended to be similar to existing reviews for other health-related changes. However, this requirement does not apply if a hospital closes due to bankruptcy or if the operational changes are necessitated by a disaster like a fire or flood, as determined by the MDH commissioner. The MDH commissioner will use existing powers to enforce these new provisions.
