Bill Summary

AN ACT To amend and reenact Code of Criminal Procedure Art. 320(G), relative to conditions of bail undertaking; to provide for conditions for setting bail; and to provide for related matters.

AI Summary

This bill modifies existing law regarding bail conditions for defendants accused of certain offenses, specifically expanding the list to include human trafficking and trafficking of children for sexual purposes. When setting bail for individuals charged with domestic offenses, stalking, sex offenses, or these new human trafficking-related crimes, courts must now consider the defendant's criminal history and whether they pose a threat to the victim. If a threat is determined, bail conditions will include prohibiting contact with the victim, their residence, school, and workplace, as well as any communication with the victim or their immediate family, unless the victim or family member consents through a court order. For human trafficking offenses, additional employment restrictions are mandated, preventing defendants from working in certain jobs that involve transportation, providing services in residences, supervising children, or operating amusement rides, after considering their criminal history and public safety threat. The bill also allows courts to consider statistical data regarding recidivism for certain sexual offenses.
