AN ACT to amend the education law, in relation to the use of airway clearance devices in schools

This bill amends education law to allow for the use of airway clearance devices in schools, defining these as portable medical devices that use suction to clear a blocked airway during a choking emergency and are registered with the U.S. Food and Drug Administration (FDA) as Class II acute upper airway obstruction devices. Schools that have these devices, whether purchased or donated, must create policies for their use by school nurses and employees, which will include training on airway management and how to use the device to remove obstructions. The cost of this training may be reimbursed if deemed necessary by the school board. Furthermore, schools that provide these devices will generally be protected from liability for damages arising from their use by someone voluntarily providing emergency treatment, with an exception for cases covered by section three thousand-a of the public health law.
