This bill enacts a new provision within Louisiana Revised Statute 29:726, granting the Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP) the authority to establish cybersecurity standards for local and political subdivisions that request state help after a cyberattack. These rules, to be created following the Administrative Procedures Act, will outline technical management practices to ensure compliance with national cybersecurity standards and define who is eligible to receive state assistance. Importantly, the bill clarifies that GOHSEP can still provide services to subdivisions that don't meet these standards, but those noncompliant entities will be responsible for reimbursing the state for the costs of such support. The GOHSEP is also permitted to use an expedited "emergency rulemaking" process for the initial creation of these rules.
